7. Liability, complaints, legal recourse

The operator’s competition is subject exclusively to the law of the Federal Republic of Germany.

The organizer’s decision is final. Participants have no enforceable claim to the disbursement of the prize.

In particular, HOBART is not liable for the availability of the website. HOBART also shall not be liable for any transmission errors.

Furthermore, HOBART shall not be liable for the loss, lateness, delay, amendment, manipulation and/or misrouting of emails and/or data during data entry, recording, transmission and/or saving, which originate from third-party data networks, in particular the Internet or world wide web, third-party phone lines and/or other hardware and/or software belonging to the participant and/or third parties; this relates in particular to faulty, missing, interrupted, deleted or defective data. HOBART shall not be liable for incorrect information that has been generated by participants and/or third parties, their hardware and/or software and is needed for or related to the competition. In particular, no liability shall be assumed if emails or data entries do not meet the requirements stipulated therein and if they are not accepted by the system as a result. Otherwise, HOBART shall only be liable for incidents of gross negligence or intent by its legal representatives, employees or agents. However, claims for damages arising from the violation of material contractual obligations shall be limited to typical foreseeable damages unless liability is assumed due to intent, gross negligence or injury to life, limb or health. The above provisions do not imply a change to the burden of proof to the participant’s detriment.

8. Final provisions
If a provision of these conditions of participation is or becomes invalid, this shall not affect the effectiveness of the remaining provisions. In this case, the organizer and participants shall work together to agree on provisions that come as close as possible to the aim of the ineffective provision.
